Recitals and Binding Assent
THIS UNIFIED MASTER LEGAL CHARTER (hereinafter referred to as the “Agreement”, “Charter”, or “Policy”) is an electronic record in the form of an electronic contract. This Agreement is drafted in accordance with the provisions of applicable Indian statutes and the rules made thereunder.
This Agreement constitutes a legally binding and enforceable contract between the administrative authority operating the educational network (hereinafter referred to as the “Administrators”, “We”, “Us”, or “Our”) and any individual, entity, or automated agent accessing said network (hereinafter referred to as the “User”, “Visitor”, “Student”, or “You”). By accessing, browsing, interacting with, or utilising any resource, programme, or service provided on our domains, you expressly acknowledge that you have read, comprehensively understood, and unconditionally agreed to be bound by the entirety of the stipulations, provisions, covenants, and limitations articulated within this Charter. If you do not agree to these terms in their entirety, your sole and exclusive remedy is to immediately cease the use of the network.

Article 1: Definitions and Interpretations
1.1. Definitions
For the purposes of this Agreement, the following terms shall be ascribed the specific meanings detailed herein:
- “Apex Domains” refers to the primary root domains registered and operated by the Administrators, specifically abhishek.io.in and abhishekinbh.com.
- “Network” refers collectively to the Apex Domains, all associated subdomains, portals, directories, and server infrastructure.
- “Digital Assets” encompasses all tangible and intangible digital property hosted on the Network, including, but not limited to, HTML source code, CSS stylesheets, JavaScript files, application programming interfaces (APIs), databases, PDF documents, academic notes, question banks, worksheets, and media files.
- “Third-Party Ad Providers” refers to external corporate entities (e.g., Google) that programmatically deliver advertisements to the Network based on algorithmic targeting.
Article 2: Universal Jurisdiction and Scope of Application
2.1. Unconditional Inclusivity
The clauses, covenants, and limitations enclosed herein apply comprehensively, uniformly, and unconditionally to all websites, directories, portals, subdomains, and digital environments operating under the Apex Domains. This explicitly includes all present and future resource centres, administrative sub-directories, and allied educational programmes associated with these primary domains.
2.2. Governance of Digital Assets
Furthermore, this unified policy strictly governs all Digital Assets hosted, distributed, or displayed across these networks. Accessing, scraping, viewing, or downloading any Digital Asset from our Network, whether via manual browsing or automated computational requests, constitutes an immediate, irrevocable, and binding acceptance of these terms. No asset may be reproduced or mirrored without acknowledging the governance of this Charter.
Article 3: Educational Mandate and Non-Commercial Intent
3.1. Philanthropic Endeavour
Our Network is established fundamentally as a philanthropic, non-profit academic endeavour. Every programme, application, document, and resource hosted across our domains is provided strictly for educational, instructional, and academic enrichment. The primary objective is the democratisation of education.
3.2. Absence of Mandatory Subscriptions
We are steadfastly committed to providing high-quality learning materials completely free of charge to the student community. The Administrators shall not demand, solicit, or require any mandatory subscription fees, paywalls, or premium memberships for accessing the core educational materials hosted on the Network.
Article 4: Financial Operations, Monetisation, and Server Upkeep
4.1. Purpose of Financial Generation
The provision of a high-bandwidth digital platform inherently incurs substantial operational expenditures. To sustain this standard of free education and to ensure the uninterrupted availability of our resources, the Network engages in specific, strictly governed financial operations.
4.2. Donations and Voluntary Contributions
We may solicit voluntary financial contributions or donations from our users, parents, or well-wishers. It is hereby unequivocally declared that all such donations are exclusively harnessed to cover recurring operational expenditures. These expenditures strictly encompass server hosting fees, domain name renewals, security architecture maintenance, bandwidth scaling, and the continuous development of new academic content.
4.3. Advertisements and Affiliate Governance
To further supplement the financial requirements of maintaining server infrastructure, our platforms may display third-party advertisements or utilise affiliate marketing links. You acknowledge, understand, and agree to the following conditions regarding third-party monetisation:
- Allocation of Revenue: All revenue generated through such advertisements or affiliate links is strictly governed and harnessed solely for the fulfilment of server maintenance costs, administrative upkeep, and the continued provision of free academic materials.
- Third-Party Ad Governance: The advertisements displayed on our network are served and governed entirely by external Third-Party Ad Providers. The Administrators do not manually curate, pre-screen, or explicitly endorse the commercial products, services, or entities advertised therein.
- Behavioural Targeting and User Tracking: These Third-Party Ad Providers rely extensively on cookies, web beacons, and similar tracking technologies. They may utilise data regarding your previous browsing activities and behavioural patterns across the broader internet to serve you with personalised, targeted advertisements. The Administrators exert absolutely no control over these external tracking algorithms, their data processing methodologies, or their subsequent privacy policies.
Article 5: Intellectual Property and Copyright Compliance
5.1. Fair Dealing for Educational Instruction
The Administrators hold a profound respect for intellectual property rights. We make every reasonable, good-faith endeavour to ensure that the academic materials hosted on our Network are either originally authored, sourced from the public domain, or fall firmly under the purview of “Fair Dealing” as prescribed by Section 52(1)(i) of the Indian Copyright Act, 1957. This specific statutory provision permits the reproduction of any work by a teacher or a pupil in the course of instruction.
5.2. Notice and Takedown Procedure (DMCA Equivalent)
Notwithstanding our rigorous internal compliance checks, if you are a rightful copyright holder (or an authorised agent thereof) and possess a bona fide belief that your proprietary material has been inadvertently utilised in a manner that exceeds the boundaries of fair educational use, you are required to notify us immediately. Upon receipt of a valid, formal, and polite request detailing the specific URL and providing prima facie proof of ownership, we shall promptly organise the immediate removal, modification, or proper attribution of the contested material in compliance with safe harbour provisions.
Article 6: Comprehensive Privacy Policy and Data Protection
6.1. Data Minimisation and Anonymity
We prioritise the digital safety and privacy of our student demographic. We deliberately abstain from requiring users to create registered accounts to access our standard study materials. Consequently, we do not actively or covertly harness, collect, or store Personally Identifiable Information (PII) such as names, physical addresses, or financial data, except where explicitly and voluntarily provided by the user during a donation process via secure, external third-party payment gateways.
6.2. Automated Data Collection and Analytics
To assist in optimising server performance, mitigating security threats, and organising our educational resources more effectively, we automatically monitor generic, anonymised traffic data. This includes the collection of non-identifying metrics such as aggregate page views, geographical region (resolved at the city/country level), device specifications, browser types, and referral sources. This data is processed strictly in aggregate.
6.3. Strict Prohibition of Data Brokering
Under no circumstances, nor under any financial inducement, do the Administrators sell, rent, broker, or distribute any user data, behavioural profiles, or analytical metrics to third-party marketing agencies, corporate entities, or unauthorised external actors.
Article 7: Automated Compliance and Cryptographic Contact Registry
7.1. Wildcard Compliance Infrastructure
To ensure seamless communication and swift resolution of any technical, structural, or compliance issues, our network routing utilises a sophisticated wildcard email infrastructure. Standard compliance communications directed to our Apex Domains will be automatically received and diligently processed.
7.2. Anti-Scraping Cryptographic Implementation
In order to protect our administrative infrastructure from automated spam, malicious harvesting bots, and malicious web scrapers, our official contact channels are deployed using advanced Base64 cryptographic obfuscation. Article 8: Disclaimers, Limitations of Liability, and Indemnification
8.1. Disclaimer of Warranties
All academic materials, question banks, study notes, software tools, and related digital assets provided on our network are offered on a strictly “as is” and “as available” basis, without warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular educational purpose, and non-infringement.
While we meticulously verify our content to ensure high academic standards, we do not guarantee the absolute accuracy, completeness, or currentness of the information provided. The materials are intended exclusively to supplement, not to replace or supersede, official academic textbooks, formal classroom instruction, or certified pedagogical guidance.
8.2. Limitation of Liability
Under no circumstances, nor under any legal or equitable theory, whether in tort, contract, strict liability, or otherwise, shall the administrators, educators, webmasters, or contributors affiliated with this network be held liable to you or to any other person for any direct, indirect, special, incidental, or consequential damages of any character arising out of the use of, or inability to use, our educational resources.
We shall explicitly not be held legally or financially accountable for poor academic performance, adverse examination results, data loss, device malfunction, or any negative outcomes whatsoever stemming from a User’s reliance on the study materials hosted on our domains.
8.3. Indemnification
You agree to indemnify, defend, and hold harmless the Administrators, their affiliates, and contributors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your violation of these Terms or your misuse of the Network.
Article 9: Safe Harbour and Absolute Non-Litigation Covenant
9.1. Strict Prohibition of Legal Warfare
It is a strict, unyielding condition precedent to the use of this Network that no legal warfare, aggressive litigation, or frivolous legal notices shall be entertained against the Administrators.
Given the purely educational, community-driven, and non-profit nature of our platforms, we operate strictly in good faith for the betterment of society. We demand that all grievances, whether related to copyright infringement, data privacy concerns, or content accuracy, be resolved amicably and cooperatively through our standard communication channels outlined in Article 7.
Threatening legal action, initiating punitive lawsuits, deploying automated cease-and-desist mandates, or engaging in hostile legal posturing against an initiative designed solely for the philanthropic betterment of students is strictly unwarranted, explicitly hostile to our core mission, and will not be acknowledged as productive dialogue. The User expressly waives any right to instigate frivolous litigation against the Network.
Article 10: Governing Law, Dispute Resolution, and Exclusive Jurisdiction
10.1. Governing Law
This Unified Master Legal Charter, and any disputes, claims, or controversies directly or indirectly arising out of or relating to the use of our educational networks, shall be exclusively governed by, construed, and enforced in accordance with the laws of the Republic of India, without regard to its conflict of law principles or provisions.
10.2. Exclusive Territorial Jurisdiction
Should any cooperative resolution fail despite exhaustive, documented amicable efforts from both parties, it is hereby irrevocably agreed and stipulated that any legal proceedings, litigations, or formal disputes shall be subject to the absolute, exclusive, and indefeasible jurisdiction of the competent courts situated geographically within East Champaran, Bihar, India. The User expressly consents to the personal jurisdiction of such courts and waives any objection regarding inconvenient forum (forum non conveniens).
10.3. Severability and Integration
If any provision of this Charter is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect. This Document constitutes the entire agreement between the User and the Administrators superseding all prior communications or proposals.
Declaration of Assent
By continuing to access, browse, or utilise any aspect of our educational network and its associated digital assets, you formally acknowledge and unconditionally consent to all the terms, policies, stipulations, and non-litigation covenants articulated in this comprehensive legal instrument.
